Mobile Phones - Do you know the issues ?

The law also makes it an offence for employers to cause or permit their staff to use their phones while driving? This is of major concern to employers. How do you ensure that you do not fall foul of this aspect of the law? What happens if you phone an employee while he/she is driving?

Recent guidance from the Health and Safety Executive makes it clear that employers have a duty under health and safety law to manage the risks faced by their staff while on the road. Research clearly shows that using a hands-free phone while driving can be just as dangerous as using a hand-held phone. It is therefore essential that the correct hands-free equipment is used.


The DfT estimates that in the first year of the regulations, there will be up to 100,000 fixed penalty notices issued, resulting in up to £3m in fines. It is intended that the use of a hand-held phone will eventually become an endorseable offence.
